terms of service

last updated october 29, 2026 · version 2026-10-29

who's who. "i", "me", "my" means Astrozombie LLC dba c0ffee0verd0se. "you" means the business named on the client sign-off and the person who signed for it. these terms, the client sign-off you submitted, the refund policy, and any written quote together are the whole agreement. plain english on purpose; it's still a contract.

1. what i provide

one or more of: a custom website build (one-time fee), monthly hosting, a monthly care plan, brand work, and custom apps. what's included is exactly what's listed on the sign-off, the websites page, or your written quote at the time you signed. nothing else is included. estimates of time ("live in 2–3 days") are estimates and depend on you sending what i need; they're not deadlines i'm liable for missing.

2. builds: revisions, acceptance, payment

  • a build includes up to three rounds of revisions within 14 days of the first draft. a "round" is one consolidated list of changes from you. further rounds, or changes after 14 days, are $75/hour or quoted.
  • a build is accepted when you approve it in writing (text is fine), when it goes live, or 7 days after i deliver it without objection, whichever comes first.
  • build fees are due in full before the site goes live. i may require a deposit to start. unpaid builds don't launch.
  • changes to scope after you approve a quote are quoted again before i do them.

3. monthly plans and billing

hosting and care plans bill automatically through stripe every month on the day you signed up. prices can change with 30 days' notice by email. care-plan change hours don't roll over. extra time is $75/hour, approved by you (text is fine) before it's done. my fees don't include any sales tax or similar; if any applies, it's added.

4. month to month, and how to cancel

  • no contract term. either of us can end a monthly plan with 30 days' written notice by email: you to jadevalore@gmail.com, me to the email on your sign-off. texts, DMs, voicemails and in-person don't count as notice.
  • billing continues through the notice period; no refunds for it.
  • i can also end service immediately, without the 30 days, if a plan is more than 14 days unpaid, if the site is used for anything illegal, or if you're abusive to me. you'll still get your files.

5. what happens when a plan ends

  • during the notice period i send you one zip of your site files: HTML, CSS, JavaScript, images, fonts i'm allowed to pass on, and any other files that are yours.
  • after your final billing date the site is removed from my hosting, and after 60 days i may delete my copies. keep your zip somewhere safe.
  • i don't provide setup instructions, migration assistance, DNS changes, or support for hosting the site anywhere else. that's on you or whoever you hire.
  • your domain is registered in your name and is yours. i'm not responsible for a domain expiring, DNS you change, or email you host elsewhere.
  • accounts in your name (stripe, termly, your registrar, sendgrid, square) are yours; i'm not responsible for them after service ends.

6. things you pay directly

domain and email registration, stripe fees on payments your site takes, your termly subscription, SMS/email sending costs, and any third-party service that outgrows its free tier. those companies bill you. legal pages: set-up of your privacy policy, terms, refund policy and cookie banner through termly is included in a package, but the termly account must be yours: you create it and give me access. termly generates the text; i install it. i'm not a lawyer and don't warrant that those policies are legally adequate for your business.

7. your content, your business

  • you own your logo, photos, copy, menus, prices and brand. you confirm you have the rights to everything you give me, including photos of people and other people's brands.
  • you're responsible for the accuracy and legality of your content and claims (prices, allergens, "organic", health claims, licenses, giveaways, anything regulated). i don't check them.
  • you're responsible for your own legal compliance: business licenses, health permits, sales tax, employment law, privacy law, and accessibility law (section 10). i build the site; i don't run your business.
  • once your build is paid in full, the site files i delivered are yours. i keep the right to reuse my own general techniques, code patterns and components in other projects, and to show the work in my portfolio and on social media unless you tell me in writing not to.

8. access and confidentiality

you may give me access to accounts (termly, stripe, your registrar, netlify, square). i use that access only to do the work, keep logins confidential, and don't share them. prefer adding me as a collaborator over sharing a password; you can revoke my access any time. i'm not responsible for what happens in those accounts outside the work i do.

9. third-party services, uptime, security

your site depends on services i don't control: netlify, stripe, sendgrid, square, instagram, your registrar, and others. i'm not responsible for their outages, price changes, API changes, policy changes, or shutdowns, or for data they hold. hosting uptime is whatever netlify provides; i don't guarantee uptime. no website is unhackable; i follow reasonable practices but don't guarantee the site, your accounts, or your customers' data won't be breached. i keep a copy of the site files while you're on a plan; i don't back up your customers' data in third-party systems.

10. accessibility

i build to current web accessibility practices (WCAG 2.2 AA): keyboard navigation, screen-reader labels, color contrast, reduced-motion support, skip links, real form labels. before launch i run an accessibility check and deliver a short report listing what was checked, the tools used, and the score. that report is a record of good-faith work, not a legal guarantee. i'm not a lawyer and don't warrant that any site complies with the ADA, the unruh act, or any other law. legal compliance is your responsibility as the business owner, and content, images, videos, embeds or pages you add after launch can affect accessibility. if you receive a complaint or demand letter, tell me and i'll help you fix anything on the site at my then-current rates (free under a care plan). i'm not liable for claims, damages, settlements or legal costs arising from the accessibility of the site.

11. no guarantee of results

i build sites meant to get you booked, found and paid. i don't guarantee any result: bookings, sales, search rankings, followers, reviews, or that any customer will do anything. marketing language on my site ("booked is the goal") is a design philosophy, not a promise.

12. failed payments

if a payment fails, stripe retries automatically. if a plan is unpaid for 14 days the site may be paused until the balance is current. i'll text you before pausing. you're responsible for any chargeback fees caused by disputing a valid charge.

13. response times

i aim to reply the same business day and usually faster. i'm one person, not a 24/7 help desk. growth plans get priority turnaround within one business day. there's no uptime or response-time guarantee beyond that.

14. refunds

see the refund policy. monthly fees are non-refundable once the month starts. build fees are non-refundable once work has begun.

15. you cover me for your stuff (indemnification)

you'll defend me and cover my costs (including reasonable attorney's fees) for any claim by a third party that comes from: your content, products, services, prices or claims; your business operations; intellectual property you gave me; data you collect through your site; your use of third-party services; accessibility claims about your site; or your breach of these terms.

16. limits on my liability

to the maximum extent the law allows: i'm not liable for lost profits, lost sales, lost data, lost goodwill, or any indirect, incidental, special or consequential damages, however they arise, even if i was told they were possible. my total liability for anything related to these services is capped at the amount you paid me in the three months before the claim arose. the services are provided "as is" beyond what these terms expressly say; i disclaim all other warranties, including merchantability and fitness for a particular purpose. some of these limits may not apply where the law doesn't allow them.

17. disputes

california law governs. before either of us sues, we'll talk for 30 days to try to fix it. any lawsuit goes in the state or federal courts in orange county, california, and you agree to that venue. either of us may use small claims court instead. the winning side in any lawsuit gets its reasonable attorney's fees and costs from the other side.

18. the rest

  • electronic signature. you agree to do business electronically. typing your name on the client sign-off is your signature under the federal E-SIGN act and california's uniform electronic transactions act, and it's as binding as ink.
  • authority. the person signing is at least 18 and authorized to bind the business.
  • independent contractor. i'm an independent contractor, not your employee, partner or agent.
  • force majeure. neither of us is liable for delays caused by things outside our reasonable control (outages, disasters, illness, government action).
  • changes. i'll email you at least 30 days before any change to these terms takes effect. staying on a plan after that date means you accept the change. the version you signed is recorded with your agreement and archived at its own address.
  • assignment. i may assign this agreement to a company i own. you may not assign it without my written okay.
  • severability, no waiver, entire agreement. if a part of this is unenforceable, the rest stands. not enforcing something once doesn't waive it. this is the entire agreement and replaces anything we said before.
  • notices. legal notices go by email: to me at jadevalore@gmail.com, to you at the email on your sign-off. a notice counts as received the next business day.

keeping a copy. you can download or print this page any time with the button at the top, and this exact version stays at the archived address below for as long as my site is up. your signed sign-off also included a downloadable copy of what you agreed to, and i email you the signed record.
